These Terms of Service ("Terms") govern your use of the website craftandhype.com (the "Site") and the marketing services provided by Viable Technologies LLC, doing business as Craft & Hype ("Craft & Hype," "we," "us," or "our"). By accessing the Site or using our services, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.
1. About Our Services
Craft & Hype is a digital marketing agency that provides lead generation, search engine optimization, paid advertising management, website development, reputation management, local presence management, email/SMS marketing, social media management, and related services for home service businesses. A full description of our service offerings and pricing is provided during the sales process and detailed in your service agreement.
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into a binding agreement to use our Site and services. By using our services, you represent that you meet these requirements.
3. Account and Client Responsibilities
When you engage Craft & Hype for services, you agree to:
- Provide accurate, complete, and current information about your business
- Grant us necessary access to your third-party accounts (Google Ads, Google Business Profile, Meta Business Suite, website hosting, etc.) as required to perform services
- Respond to requests for approvals, information, and feedback in a timely manner
- Comply with all applicable laws and regulations related to your business and industry
You are responsible for maintaining the confidentiality of any login credentials you share with us.
4. Service Agreements and Billing
Specific service terms, scope, pricing, and payment schedules are outlined in your individual service agreement or proposal. In the event of a conflict between these Terms and your service agreement, the service agreement controls.
- All monthly services are billed on a recurring basis as specified in your service agreement.
- Payment is due on the date specified in your invoice. Late payments may result in suspension of services.
- You pay advertising platforms (Google, Meta, etc.) directly. Craft & Hype does not mark up or handle your ad spend.
- Setup fees and one-time project fees are non-refundable once work has begun.
5. Ownership of Work and Intellectual Property
What You Own
- Your website, once delivered, transfers to your Webflow account (or hosting platform of your choice). You own it.
- Your ad accounts (Google Ads, Meta Ads) remain in your name at all times.
- Your data in Google Analytics, CallRail, and other analytics platforms belongs to you.
- Content we create specifically for your business (landing pages, blog posts, ad copy, email sequences) is yours upon payment in full.
What We Own
- Craft & Hype retains ownership of our proprietary processes, methodologies, templates, frameworks, and tools used to deliver services.
- We reserve the right to use anonymized, aggregated data and general learnings from our work for internal improvement and case studies, provided no confidential client information is disclosed without your written consent.
6. SMS/Text Messaging Terms
By opting in to receive SMS/text messages from Craft & Hype, you agree to the following:
Consent
You consent to receive SMS/text messages from Craft & Hype at the phone number you provide. Consent is not required as a condition of purchasing any services. You may receive messages related to appointment reminders, service updates, responses to inquiries, and promotional content (if separately opted in).
Message Frequency
Message frequency varies. Promotional messages will not exceed 4 per month.
Message and Data Rates
Standard message and data rates may apply depending on your mobile carrier and plan.
Opt-Out
You may opt out at any time by replying STOP to any message. Additional opt-out keywords include: STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT. After opting out, you will receive one confirmation message. No further messages will be sent unless you provide new opt-in consent.

Privacy
Your phone number and messaging consent are never sold, rented, or shared with third parties for their marketing purposes. See our Privacy Policy for full details on how we handle your data.
Supported Carriers
Major US carriers are supported, including AT&T, T-Mobile, Verizon, and others. Carrier support is not guaranteed, and delivery may be affected by carrier policies.
7. Acceptable Use
You agree not to use the Site or our services to:
- Violate any applicable law, regulation, or third-party rights
- Submit false, misleading, or fraudulent information
- Interfere with or disrupt the Site or its underlying infrastructure
- Attempt to gain unauthorized access to any part of the Site or related systems
- Use any automated means (bots, scrapers, crawlers) to access the Site without our written consent
- Transmit any malware, viruses, or harmful code
We reserve the right to suspend or terminate access to the Site or services for any user who violates these Terms.
8. Third-Party Services and Links
Our Site may contain links to third-party websites, tools, or services. We are not responsible for the content, privacy practices, or availability of any third-party sites. Your use of third-party services is governed by their own terms and policies.
We use third-party platforms to deliver services (including but not limited to Google, Meta, Webflow, Twilio, Make.com, CallRail, AgencyAnalytics, and SEMrush). Your use of these platforms is subject to their respective terms of service.
9. Disclaimers
Services are provided "as is." While we work diligently to generate leads and improve your online presence, we do not guarantee specific results, including rankings, lead volume, revenue, or return on investment. Marketing outcomes depend on many factors beyond our control, including market conditions, competition, seasonality, and your business operations.
We do not guarantee uninterrupted or error-free operation of the Site.
10. Limitation of Liability
To the maximum extent permitted by law, Viable Technologies LLC and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or our services, including but not limited to lost profits, lost data, or business interruption.
Our total liability for any claim arising from or related to these Terms or our services shall not exceed the total fees you paid to Craft & Hype during the three (3) months immediately preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Viable Technologies LLC, its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site or services, your violation of these Terms, or your violation of any law or third-party rights.
12. Termination
Either party may terminate monthly services with 30 days' written notice. Upon termination:
- You retain ownership of all assets described in Section 5.
- Outstanding invoices remain due and payable.
- We will provide reasonable assistance in transitioning access to your accounts and deliverables.
We reserve the right to terminate services immediately if you breach these Terms or engage in conduct that is harmful to our business or reputation.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Ohio. Both parties consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site or services after changes are posted constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with your service agreement and our Privacy Policy, constitute the entire agreement between you and Viable Technologies LLC regarding the Site and services. These Terms supersede any prior agreements or communications.
